Public Space Permits

Public Space Permit Information

The City of Birmingham’s Public Space Permit allows a retail store or restaurant to set up outdoor business operations in the City’s right-of-way (sidewalks, on-street parking spaces, and private parking lots). With a Public Space Permit, businesses can open or expand into the sidewalk and parking spaces while keeping our residents safe, healthy, and happy. The complete ordinance can be found here.

The Public Space Permit is an annual, renewable permit. Fees are outlined in the ordinance and can be found below. Inspections will now take place annually, as well as periodically throughout the year.

This permit is only applicable for the physical locations of existing or new businesses. For food truck or mobile food permitting, please consult the mobile food vendor application process on the Permits page.
