In July of 2022, the major sections of code enforcement for Birmingham were combined into one Division within the Department of Planning, Engineering and Permits. This organizational transition has provided for additional synergies between the various sections of code enforcement. The major sections under the Code Enforcement Division include Zoning, Housing, Condemnation/Demolition and Environmental Code Enforcement.
Zoning:  Zoning Code Enforcement is responsible for inspecting private property complaints in violation of the Zoning Ordinance of the City of Birmingham. Zoning violations include parking in a required front yard (though enforced primarily by the Birmingham Police Department, business use of residential property, fence violations, outside storage, accessory structures, excessive signage, home occupations, communal living facilities, Zoning Board of Adjustment cases, Zoning Advisory Committee cases, and Public Safety Committee cases, certifying urban agriculture and authorizing the operation of a child or adult care facility.

Housing: Housing Code Enforcement is responsible for inspecting properties reported to be in violation of the City’s Property Maintenance Code. These include issues such as deteriorated roof systems, damaged windows or doors, chipped exterior paint, damaged or deteriorated fascia, soffits, or other exterior features, as well as inadequate utility service.

Condemnation/Demolition: Condemnation and Demolition Code Enforcement is responsible for the inspection of structures that may be deemed condemnable and unsafe to the extent that they constitute a public nuisance as defined by the City’s Technical Code. Factors that may lead to a condemned structure include burned structures, doors and windows removed, roof collapsing, weak and sagging floors, portions of the building falling in, vandalism of property, trees fallen into structure and structures sustainably damaged by a natural hazard (tornado, flood).

Environmental:  Environmental Code Enforcement is responsible for enforcing codes involving yard maintenance, inoperative motor vehicles, and junk, trash & debris. Maintenance of yards, and swales/rights-of-way abutting the property are the responsibility of the owner. Inoperative and/or derelict vehicles are not permitted. Junk, auto parts, furniture, trash, tires, building materials, tree trimmings and any other debris cannot be left in the yard and must be properly disposed of.

How to Report a Code Violation and What to Expect Next

  • If you notice a code violation in your neighborhood, call 311 and submit a complaint.
  • Please be sure to include the date of the violation and the address.
  • Once the city receives the complaint, a city inspector will go out and investigate
  • After an investigation has been done, the magistrate’s office will determine if a violation occurred and if a person will be charged.
  • If a person is charged, they will be notified that they have a charge pending against them for violating an ordinance.
  • The case will be then heard in Environmental Court.
  • Environmental Court is held every Wednesday at 9 a.m. in Birmingham Municipal court. (Cases include dilapidated structures, tires on the ground, engines and old appliances in the yard, windows out in homes, etc.).
  • Cases such as overgrown weeds, inoperable motor vehicles and structures to be demolished are declared a nuisance by the City Council and abated by third-party contractors.
